Limitation of Liability
IN NO EVENT SHALL EVITALIN BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM ANY LOSS OF USE, LOSS OF PROFITS, LITIGATION, OR ANY OTHER PECUNIARY LOSS, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS WEBSITE OR THE PROVISION OF OR FAILURE TO MAKE AVAILABLE ANY SUCH PRODUCTS, GOODS, OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Privacy and Security on the Public Site
Evitalin understands that privacy of information is of great importance to our customers and the people that visit our site. We want you to know that Evitalin does not sell information obtained through use of this website to anyone. In addition, we have established the following privacy and security practices with respect to the public portions of Evitalin websites and mobile applications.
Because we want Evitalin websites and mobile applications to better serve visitors’ needs, we collect some basic information about visitors’ computers, including:
- IP address (the computer’s unique signature)
- Operating system (e.g. Windows 10)
- Browser software (e.g. Microsoft Edge, Google Chrome, Safari, Firefox)
- Internet Service Provider (e.g. AOL)
- Geographic location (e.g. Boston, Mass.)
The information we collect about our visitors’ computers will not be used to identify individuals. Instead, we check which Web pages and services people use while they are here. For example, we use the browser information to help us design our website so that as many people as possible will be able to view the pages correctly. In short, it helps us determine what parts of the site people like and what parts they don’t, so that we can add information appropriately.
Privacy and Security on the Secured Sites
The sections of Evitalin websites and mobile applications that are password protected and require individuals to register and login, contain protected health information (PHI) and allow individuals to perform certain transactions. Because of this Evitalin must be able to link a user’s activity back to their identity. For example, when a customer changes his doctor, we must be able to make that change within our systems and we cannot do that without linking the information back to the customer. In addition, it is important for Evitalin to keep track of what functionality a customer uses. Therefore, in the password protected portion of our website, Evitalin does collect identifiable information about users. This includes information about the user’s computer as listed above, and information related to the user, such as pages visited and PHI submitted or changed.
The confidentiality, integrity and availability of your PHI are important to Evitalin. To protect against unauthorized access to PHI that is accessible on the password-protected portions of our site, Evitalin has adopted stringent security standards.
PHI that Evitalin collects from users on the password-protected portions of Evitalin websites and mobile applications is confidential. All PHI Evitalin has regarding our customers is available only to authorized users and is protected from unauthorized access by multiple layers of security controls and monitoring.
We collect email addresses as part of the registration process. We will use email addresses to notify registrants of online activity related to the security and privacy of their accounts, such as, retrievals of username, etc. In addition we will use email addresses to send customers health and wellness information and other updates that might be of interest to them as customers of Evitalin. On certain occasions we may also share email addresses with providers in our network so that they may send you information that describes health-related products and/or services offered by the provider. Each time we or any such provider sends health and wellness information and other updates, the recipient will be given the opportunity to opt-out of receiving similar emails in the future. Please note that registrants cannot opt-out of receiving emails that notify them of online activity since these are necessary to protect the privacy and security of Web accounts.
Cookie Policy & CCPA (California Consumer Privacy Act)
This website uses web analytics tools to help analyze how users use the site, for advertising purposes and to help improve visitors’ experiences on our websites. These tools use “cookies,” which are text files placed on your computer, to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the website (including IP address) is transmitted to our partners. This information is then used to evaluate visitors’ use of the website and to compile statistical reports on website activity for Evitalin. Evitalin is dedicated to providing privacy on the Internet and have provided you the opportunity to opt out of future 3rd party advertising cookies.
Evitalin allows third parties to place cookies on our site for advertising purposes. This Online Privacy Statement does not cover the collection methods or use of the information collected by these vendors. These vendors have their own privacy policies and may be customers of the Network Advertising Initiative (“NAI”). To be removed from some or all NAI customer advertising programs, please visit the NAI Opt-Out Page and follow the relevant instructions. Please note that if you delete, block, or otherwise restrict cookies, or if you use a different computer or Internet browser, you may need to renew your opt-out choice.
We will never (and will not allow any third party to) use the statistical analytics tool to track or to collect any Personally Identifiable Information (PII) of visitors to our site. We will not associate any data gathered from this site with any Personally Identifiable Information from any source unless you explicitly submit that information via a fill-in form on our website.
If you are a California resident, California law requires Evitalin to provide you with additional information regarding how we collect, use, and share your personal information.
Under California’s California Consumer Privacy Act or “CCPA”, effective as of January 1, 2020, California residents are given the right to opt out of the sale of their personal information.
While we do not sell any data of our customers, Evitalin.com uses essential and non-essential cookies. Cookies are used to improve user experience, track anonymous site usage, store authorization tokens, enhance users’ experience of site usability, marketing activities, and permit sharing on social media networks voluntarily by customers. In certain cases, sharing data with these providers could be considered a “sale” under CCPA even though it is not a sale in the traditional sense. We are therefore giving California residents the ability to opt out of the cookies and trackers that may fall under the definition of “sale” under CCPA. Please note: If you opt out of these cookies and trackers, your web experience may be severely downgraded.
